Where are Online Casinos Legal in the US?

Currently, only six states have embraced these changes and legalized online casinos: New Jersey, Pennsylvania, Michigan, West Virginia, Delaware and Connecticut.

New Jersey

New Jersey was one of the first states to embrace online casinos after then-governor Chris Christie signed SB1565 into law on February 26, 2013. This opened the doors for land-based casinos in the state to partner with online iGaming operators; On November 26 that year, 14 online casinos officially went live in the Garden State, all in partnership with the 12 Atlantic City casinos. New Jersey’s iGaming market is now fully operational with over 30 operators, all licensed and regulated by the New Jersey Division of Gaming Enforcement.

Pennsylvania

PA online casinos market is one of the biggest in the US, with over 19 operators currently active. Real money casinos were officially legalized in the Keystone State after Gov. Tom Wolf signed HB271 into law on October 30, 2017. The same bill also legalized sports betting and Daily Fantasy Sports (DFS) games. 
Online operators started going live in July 2019, with Play Sugar House being the first to launch in the state. All legal online casinos in Pennsylvania are licensed and regulated by the Pennsylvania Gaming Control Board.

Michigan

Online gambling, including casino games, sports betting, and poker, was legalized in Michigan on October 30, 2019, after Gov. Gretchen Whitmer signed HB4311 into law. Michigan state law states that there can only be 15 regulated online casinos, and all forms of regulated gambling are overseen by The Michigan Gaming Control Board; Although 2020 was the year online casinos and sportsbooks were anticipated to launch in the Great Lakes State, that was put on hold due to the COVID-19 pandemic. The first online casinos and sportsbooks opened their virtual doors to MI players in January 2021. Currently, there are 15 Michigan online casinos to choose from, including industry giants BetMGM and FanDuel.

West Virginia

West Virginia legalized online casino and online poker in 2019 when it passed the Interactive Wagering Act, a year after online sports betting was permitted in the state. Lawmakers also designated the West Virginia Lottery Commission as the regulator of all forms of gambling, land-based and online.
The Interactive Wagering Act enables WV’s five land-basic casinos to partner with up to three iGaming operators each; fifteen licenses are available in total. DraftKings was the first online casino to open its doors to Mountain State players on July 15, 2020.

Delware

Delaware was the first state to legalize online casinos and online poker in 2012 after Gov. Ned Lamont signed the Delaware Gaming Competitiveness Act into law on June 28. All gambling in the state, including internet lottery tickets, online casino games, and online poker, is regulated by the Delaware Lottery.
The First State is home to three online casinos that operate in partnership with the three racinos in the state: Delaware Park, Dover Downs, and Harrington Raceway. Each racino has an app that allows players to access slots, table games, and poker on the go.

Connecticut

Real-money online casinos have been legal in Connecticut since 2021. The legalization occurred as part of a larger gambling expansion in the state. In May of 2021, Gov. Lamont signed HB6451 into law, enabling CT players to partake in retail and online sports betting, Daily Fantasy (DFS), online lottery, Keno, and online slots and casino games; Due to the unique political situation in the state, only online casinos in conjunction with the state’s two Native American tribes can set up shop. Players in the Constitutional State have two options if they want to play casino games online: DraftKings, through a partnership with the Mashantucket Pequot tribe, or FanDuel, through an agreement with the Mohegan tribe.

The Future of US Gambling

There are only a handful of states with regulated real-money online casinos. For now, the path to widespread legalization remains complex. However, local laws are constantly changing, and more and more states are considering legalizing online casino gambling.
