Sports Betting – Legal Overview

The Christie vs. NCAA New Jersey sports betting case, was the main event that allowed sports betting to be legal today. In 2014, a New Jersey law attempted to allow state casinos and horse betting tracks to offer sports wagering online. However, this law went around a federal law called the Professional and Amateur Sports Protection Act or PASPA.

In 2018, the Supreme Court took the case, and New Jersey argued that PASPA is unconstitutional, which in hindsight, commandeers states to act on the Federal government’s behalf. The Supreme Court sided with New Jersey, stating that a federal ban on sports betting is unconstitutional.
