Is Gambling in New Jersey Legal?

The first gambling signs were recorded in the 1700s, as lotteries were used to help finance the military. Later, the state imposed a gambling ban from 1894 until 1939. However, it wasn’t widely enforced, as racetracks, bingo, and slots were just gaining availability for New Jersey residents.

The first gambling market made legal in New Jersey was horse racing in 1939, which allowed the state to profit from its two big racetracks.

In 1976, a bill was passed allowing casinos to operate in Atlantic City. It took quite a long time for online gambling to be permitted in New Jersey. Today, residents of New Jersey can enjoy casinos, sports betting, daily fantasy sports, horse race betting, and lotteries.

Online Casinos – Legal Overview

In February 2013, a bill was signed officially making New Jersey the third state in the US where online casinos were legal, and residents could play slots, blackjack, roulette, poker, and other games.

Today, a platform can apply for a gaming license and partner with an iGaming software vendor. Operators will need to pay a non-refundable fee of $100,000 at first. If they receive approval, they will also need to deposit a renewal fee of $250,000 and an annual fee of $250,000.

There are three iGaming licenses in New Jersey: Casino Service Industry Enterprise License, the Vendor Registrants, and the Ancillary Casino Service Industry Enterprise License. The DGE, or the Division of Gaming Enforcement, is the governing body that regulates all online gambling platforms in New Jersey.

Sports Betting – Legal Overview

The Christie vs. NCAA New Jersey sports betting case, was the main event that allowed sports betting to be legal today. In 2014, a New Jersey law attempted to allow state casinos and horse betting tracks to offer sports wagering online. However, this law went around a federal law called the Professional and Amateur Sports Protection Act or PASPA.

In 2018, the Supreme Court took the case, and New Jersey argued that PASPA is unconstitutional, which in hindsight, commandeers states to act on the Federal government’s behalf. The Supreme Court sided with New Jersey, stating that a federal ban on sports betting is unconstitutional.

Since the ruling of the Supreme Court, sports betting has become legal in New Jersey. Today, operators can claim a license from the New Jersey Division of Gaming Enforcement and start operating. The NJDGE also regulates all sportsbooks, ensuring they are fair, safe, and secure.

Horse Racing – Legal Overview

Horse Racing has been popular in New Jersey since the mid-1700s, as the first racetrack was opened in the 1830s. Freehold Raceway still operates today, making it one of the oldest racetracks in the USA.

The sport was first made legal in 1939, with the State Constitution authorized pari-mutuel racing. Today, there are still several racetracks that operate in the state of New Jersey. However, as horse race betting got legalized in 2020, many players tend to wager online.

The New Jersey Racing Commission provides all the licenses and oversees all the racing and wagering in the state.

Daily Fantasy Sports – Legal Overview

Before even sports betting was legal in New Jersey, residents of the state could register and play at Daily Fantasy Sports sites. New Jersey was officially the 16th US state to legalize daily fantasy sports, and not only that, but it was the first to extend some of the laws for betting on college sports.

Today, if an operator wants to open a daily fantasy sports site, they will need a license and permit from the Division of Consumer Affairs. Also, one of their servers (that will provide daily fantasy sports betting) needs to be physically located in Atlantic City.

Lottery – Legal Overview

While lotteries go way back in history, legally, New Jersey voters overwhelmingly approved the creation of a state lottery back in December 1969. In the general election, more than 80% of voters wanted a state lottery to be established.

To this day, the state lottery law enforces all the proceeds gathered from the state lottery to go toward state institutions and state aid for education. This includes higher education and senior citizen education.

New Jersey Gambling Bonuses and Promotions

While all operators include freebies for players, they will stay the same no matter which state you visit the operator. Here are some of the promotions that you will come across at iGaming sites in New Jersey:

Welcome Bonuses

The aim of welcome bonuses is to attract new players. The sign-up bonus usually contains a deposit match, meaning the operator gives a certain percentage upon your deposit. Depending on which operator you choose to play, the welcome bonus can be a single incentive, or you will get to claim multiple deposit bonuses.

No Deposit Offers

One of the best incentives you can get at these platforms is a deposit-less bonus. Doesn’t matter if you want to play casino games or place sports bets, a no-deposit bonus gives you the chance to wager without depositing your funds.

Reload Bonuses

These are similar to the welcome promotions; however, you can claim them multiple or as many times as the operator states. They can become available anytime, meaning frequent visits to the Promo section are recommended.

Loyalty and VIP Programs

Apart from the classic type of bonuses that you will find at every New Jersey gaming site, some operators also provide VIP or Loyalty programs. These are features that reward the most frequent players.

What Are the Most Popular Gambling Sites Within New Jersey?

Digitalization offers many benefits, one of which is easy access to real-life establishments. This explains why many NJ players prefer playing online, regardless of if it’s about sports betting or casino games.

In recent years, online casinos have been the most popular gambling pages in the state, with sportsbooks coming up second. On the other hand, both online and offline, horse-racing bets and lottery tickets seem equally popular. Some of the more popular NJ iGaming sites include:

  • BetMGM Casino
  • Caesars Online Casino
  • Draft Kings
  • Borgata Casino
  • Golden Nugget

Online Gambling Taxes in New Jersey

Following the legalization of all the iGaming markets, NJ lawmakers set a tax for each market.

Casino

If an operator wants to open a casino site, all the fees they need to deposit go to New Jersey’s gambling treatment programs. Furthermore, operators also get taxed 14.25% for their gross gaming revenue, while 2.5% goes toward the Casino Reinvestment Development Authority.

Sports betting

The sports betting law requires operators to pay 13% of revenue generated from sports wagers. Daily fantasy sports operators, on the other hand, are required to pay a 10.5% tax on gross in-state revenue.

Horse racing

In the state of New Jersey, horse race betting operators also need to pay a 14.25% tax on their revenue.

Lottery

When it comes to the state lottery, 34.20% of losses go toward state public schools. Because the lottery is the fourth largest revenue producer in the state, all the funds generated have been given to community colleges and universities, school nutrition programs, the Department of Human Services, and other public organizations.
